ALREADY היא תוכנה לניהול עסק (ניהול לקוחות, תוכניות אימון ותזונה, שיעורים ותורים, מדידות, חשבוניות והצעות מחיר) ואפליקציה נלווית למתאמני העסק.

השירות ניתן לעסקים. מתאמן נכנס אליו דרך קישור אישי שמוסר לו העסק שבו הוא מתאמן.

חשבון ואחריות המשתמש

בעל החשבון אחראי לדיוק הפרטים שהוא מזין, לשמירה על פרטי הכניסה ולכל פעולה שנעשית בחשבונו, כולל פעולות של חברי הצוות שהוא מוסיף.

העסק אחראי לכך שיש לו הסכמה ובסיס חוקי לאסוף ולהזין מידע על לקוחותיו ומתאמניו, ולעמוד בדיני הגנת הפרטיות החלים עליו.

אסור להשתמש בשירות לפעילות בלתי חוקית, לפגיעה באחרים, לניסיון לחדור למערכת או לפגוע בפעולתה.

תוכן כושר ובריאות

התוכניות, ההמלצות והמדדים בשירות, לרבות תוכן שנוצר בעזרת בינה מלאכותית, הם כלי עבודה למאמן ולמתאמן ואינם ייעוץ רפואי או תזונתי מקצועי.

לפני תחילת פעילות גופנית או שינוי תזונה יש להיוועץ ברופא, בעיקר אם יש מצב רפואי. האחריות לשימוש בתוכניות היא של העסק ושל המתאמן.

תשלומים וחבילות

השימוש בשירות כפוף לחבילה שהעסק בחר, כולל מגבלות כמו מספר מתאמנים פעילים, מושבי צוות ויחידות קרדיט לתכונות בינה מלאכותית. מחירים ותנאי חיוב מוסכמים מול העסק.

תשלומים של מתאמנים לעסק מתבצעים מול העסק ובאחריותו. אנחנו אינם צד לעסקה ביניהם.

חיבורים לשירותי צד שלישי

השירות יכול להתחבר לשירותים של גורמים אחרים (Google, YouTube, WhatsApp, ספקי חשבוניות וסליקה). השימוש בהם כפוף לתנאים של אותם גורמים, ואנחנו אינם אחראים לזמינותם או לפעולתם.

הסרטונים בשירות מוצגים באמצעות YouTube API Services, ובשימוש בהם אתה מסכים ל-YouTube Terms of Service (https://www.youtube.com/t/terms).

קניין רוחני

השירות, העיצוב והתוכנה שייכים לנו. המידע שהעסק מזין נשאר שלו, והוא מעניק לנו רישיון להשתמש בו רק לצורך מתן השירות.

זמינות והגבלת אחריות

השירות ניתן "כפי שהוא" (AS IS). אנחנו עושים מאמץ סביר לזמינות ולאבטחה, אך לא מתחייבים לשירות רציף וללא תקלות.

ככל שהדין מתיר, אחריותנו מוגבלת לגובה הסכום ששולם לנו עבור השירות ב-12 החודשים שקדמו לאירוע, ואיננו אחראים לנזקים עקיפים או תוצאתיים.

הפסקה

אפשר להפסיק את השימוש בכל עת. אנחנו רשאים להשעות או לסגור חשבון שמפר תנאים אלה. אחרי סגירה אפשר לבקש עותק של המידע או מחיקה שלו, כמפורט במדיניות הפרטיות.

שינויים, דין חל ויצירת קשר

נוכל לעדכן תנאים אלה, ושימוש בשירות לאחר העדכון מהווה הסכמה לנוסח החדש.

על תנאים אלה חל הדין הישראלי, ולבתי המשפט המוסמכים בישראל הסמכות הבלעדית.

The Service

ALREADY is business-management software (customer management, workout and nutrition plans, classes and appointments, measurements, invoices and quotes) with a companion app for the business's trainees.

The Service is provided to businesses. A trainee enters it through a personal link supplied by the business they train with.

Accounts and user responsibility

The account owner is responsible for the accuracy of what they enter, for keeping sign-in details safe and for everything done in their account, including actions by team members they add.

The business is responsible for having consent and a lawful basis to collect and enter information about its customers and trainees, and for complying with the privacy laws that apply to it.

You may not use the Service for unlawful activity, to harm others, to attempt to break into the system or to disrupt it.

Fitness and health content

Plans, recommendations and metrics in the Service, including content generated with artificial intelligence, are working tools for the coach and the trainee and are not professional medical or nutritional advice.

Consult a doctor before starting physical activity or changing your diet, especially with a medical condition. The business and the trainee are responsible for how plans are used.

Payments and plans

Use of the Service is subject to the plan the business chose, including limits such as active trainees, team seats and credits for artificial intelligence features. Prices and billing terms are agreed with the business.

Payments from trainees to a business are made to, and are the responsibility of, that business. We are not a party to that transaction.

Third-party connections

The Service can connect to third-party services (Google, YouTube, WhatsApp, invoicing and payment providers). Their use is subject to those parties' terms, and we are not responsible for their availability or operation.

Videos in the Service are shown using YouTube API Services; by using them you agree to the YouTube Terms of Service (https://www.youtube.com/t/terms).

Intellectual property

The Service, its design and software belong to us. The information a business enters remains theirs, and they grant us a licence to use it only to provide the Service.

Availability and limitation of liability

The Service is provided "AS IS". We make reasonable efforts for availability and security but do not promise uninterrupted or error-free service.

To the extent the law allows, our liability is limited to the amount paid to us for the Service in the 12 months before the event, and we are not liable for indirect or consequential damages.

Termination

You can stop using the Service at any time. We may suspend or close an account that breaches these terms. After closure you can ask for a copy of your data or its deletion, as described in the Privacy Policy.

Changes, governing law and contact

We may update these terms, and using the Service after the update means you accept the new version.

These terms are governed by Israeli law, and the competent courts in Israel have exclusive jurisdiction.
